MistyandSamsCash.com Terms Of Service
All contacts are required to be in English.
Any support mails or contacts of any other language will be ignored and the account holder will be suspended. No exceptions.
By signing up and actively using the MistyandSamsCash.com program you agree to all terms and conditions set forth in this agreement. MistyandSamsCash.com may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members. Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with MistyandSamsCash.com. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the MistyandSamsCash.com program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.
Responsibility of Affiliates:
You must be 13 years of age or older to participate in this program. Our program is open to both US and International members and is void where prohibited by local governing laws.
MistyandSamsCash.com will not click any members spam filter url so that member may receive our paid emails. Affiliates who signup with Mistyandsamscash.com take responsibility of being able to accept our mails for pay. Failure by the affiliate to correct this issue 24 hours after can result with the affiliate's account being deleted, banned, and all earnings forfeit. Mistyandsamscash.com will not compromise its security by clicking unknown urls that might be spoof keylogger links. It is the members responsibility to have an inbox that will receive our mails with out requiring Mistyandsamscash.com to click spam control urls.
You agree to and must use your own name, address and email address in the sign-up process and may not assume a false identity. You must provide your full name and full mailing address. You may not sign-up multiple times with different email addresses. Your computer must not be shared with another individual that has an existing MistyandSamsCash.com account.
In the event your e-mail account on file becomes closed or blocked to messages from MistyandSamsCash.com, your account will be changed to inbox email only. This also includes repetitive email messages concerning delay of delivery of your paid mails by your email service, repetitive bounced mail notifications, and repetitive email notifications of members paid mails being block by the members inbox spam settings. The webmaster will contact you by Administrative message informing you why your email service performance is now unacceptable at MistyandSamsCash.com. The webmaster will only change your settings to inbox two times. You may change the settings back. It is suggested before doing so you fix the reason why your mails were bouncing. If you again select to receive emails, and they bounce for the third time within a 30 day period, your account will be deleted, banned, and all earnings will be forfeit. Afflilliates are required to maintain a email account that will not bounce opt-in mails, that will not bounce the webmasters' contact emails, and / or send other kinds of repetitive email messages to webmasters' email inboxes.
Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. Multiple accounts using the same IP, computer Id#, payout info, email address, mailing address, name, etc., are grounds for termination and loss of any/all earnings involved in all related accounts unless written permission has been granted from current admin.
You will use your email address / password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and following the "User Account Info." link. We strongly advise not to use the same password on different websites.
You are solely responsible for any and all use of your Misty and Sams Cash account including authorization by you to any third party individual who may use your account.
Any member caught storing, saving, bookmarking, ect., any runner links and clicking those links will be terminated.
Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by Misty and Sams Cash be detected it may result in member termination and possible legal action. Any solicitation of advertisers for a confirmation email for purposes of receiving credit in your account will be grounds for immediate termination. Members sending abusive emails to the site will have their accounts suspended. We do not tolerate any abuse or harrassement to admin, staff or other members.
If you hit a 'cheatlink', the (minus)amount of the cheatlink will be deducted from your account. If your account shows you hit a cheatlink, the funds will NOT be refunded. Any cheatlink will either be a hidden link (that the naked eye cannot see and intended for bots) or will be a clearly marked entirely visible link. If your account shows you hit a (bot)cheatlink your account will be suspended.
Any affiliate sending us gibberish will result in automatic termination of account and Forfeiture of All earnings to date of termination. Auto-responses will also be deleted immediately. Members are not allowed to bookmark account pages such as paid2click pages etcetera, these pages are changed often and will therefore become invalid pages. Members found clicking on pages through bookmarks will be suspended.
MistyandSamsCash.com does not allow the selling of accounts, referrals or redeemed advertising without prior written consent, members found selling either ads, referrals or accounts are having their account terminated. Accounts are suspended after inactivity for 30 days, accounts in vacation mode will be deleted after 35 days. Members with obvious invalid information, such as but not limited to N/A as address, the ip tracing back to china but the account says USA, or members with profiles that are not in english and thus are not readable to us will have their account terminated
Relationship of the Parties:
You and MistyandSamsCash.com are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and MistyandSamsCash.com. You understand that you do not have authority to make or accept any offers or make any representations on behalf of MistyandSamsCash.com. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.
Limitation of Liability:
MistyandSamsCash.com will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or MistyandSamsCash.com program, even if MistyandSamsCash.com has been advised of the possibility of such damages. Furthermore, MistyandSamsCash.com aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.
Payments:
Affiliates may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by MistyandSamsCash.com. Members will earn a percentage of advertising revenues collected by MistyandSamsCash.com. Members will be paid via PayPal, MistyandSamsCash.com will pay members when their balance reaches the minimum payout rate set by MistyandSamsCash.com and they use the redeem feature to request payment. Payments of earnings will be paid within 30 days, but normally within 48 hours.
Spam:
You may not promote us through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with Misty and Sams Cash and may result in legal prosecution. MistyandSamsCash.com strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. MistyandSamsCash.com may charge up to $5 per spam email sent.
Privacy
MistyandSamsCash.com has created this privacy statement in order to demonstrate our firm commitment to privacy.
Affiliates' information will always be kept in the strictest of confidentiality. MistyandSamsCash.com will never give out any or your information to 3rd parties unless required by the laws of the United States. This does NOT include screenshots required by various 3rd party programs to provide 'seals' on MistyandSamsCash.com.
Mistyandsamscash.com will not abuse your privacy.
MistyandSamsCash.com uses your IP address to help diagnose problems with our server, and to administer our Web site. Your IP address is used to gather broad demographic information. MistyandSamsCash.com is not responsible for the privacy practices or the content of such Web sites. MistyandSamsCash.com uses a sign-up form for new affiliates and advertisers. We collect visitor's contact information (like their e-mail address, address, and name). The affiliate's contact information is used to get in touch with the affiliate when necessary. Affiliates may opt-out of receiving future mailings; see the choice/opt-out section below.
Choice/Opt-Out:
MistyandSamsCash.com provides affiliates the opportunity to opt-out of receiving communications from us at the point where we request information about the visitor. MistyandSamsCash.com gives affiliates the following options for removing their information from our database to not receive future communications or to no longer receive our service. Log in to your account and click the "User Account Info." Link. At the bottom of the page you will find the option to "Cancel Account". You may also contact us and request your affiliateship to be canceled at anytime.
